Terms & Conditions

Effective Date: 17 September 2026

These Terms and Conditions listed 1-21 below apply to tours provided by The Streets Where It Happened Walking Tours (“we,” “us,” or the “Company”).

For purposes of these Terms:

  • “Booking Party” means the person or organization making and paying for the reservation.

  • “Participants” means all persons attending the tour under that reservation.

  • “Tour Fee” means the price charged for the tour as a whole, rather than a separate admission price for each Participant.

By making a reservation, the Booking Party agrees to these Terms and Conditions and is responsible for communicating applicable tour requirements, including age, conduct, photography, and recording requirements, to all Participants included in the reservation.

1. Reservations

Submitting an inquiry about a date or time does not by itself create a confirmed reservation.

A tour is reserved only after we have confirmed the requested tour and any required payment has been successfully received. The Booking Party should review the confirmation carefully and promptly notify us of any errors.

The Booking Party is responsible for providing accurate contact information and for communicating relevant tour information and participation requirements to the Participants.

2. Payment

The Tour Fee applicable to a reservation is the price quoted or displayed at the time the reservation is made.

Unless otherwise stated in writing, payment of the Tour Fee is required to confirm a reservation.

The Tour Fee applies to the booked tour as a whole and is not divided into separate admission charges attributable to individual Participants.

Any optional gratuity for your guide is not included in the Tour Fee unless expressly stated otherwise.

3. Booking Party Cancellations and Changes

We understand that plans sometimes change.

The Booking Party may cancel a confirmed reservation for a full refund of the Tour Fee by providing notice of cancellation at least 48 hours before the scheduled starting time of the tour.

Cancellations made less than 48 hours before the scheduled starting time are nonrefundable.

Requests to cancel or change a reservation should be made using the contact information provided with the booking. A cancellation or requested change is not effective until received by the Company and acknowledged in writing. For purposes of the 48-hour cancellation deadline, timely notice is determined by when the cancellation request is received by the Company.

At our discretion and subject to availability, we may permit a Booking Party to reschedule a tour rather than cancel it. Any rescheduling arrangement must be confirmed in writing, including by electronic communication, by the Company.

Changes to the date, time, number of Participants, or other details of a reservation are subject to availability and are not effective unless confirmed in writing, including by electronic communication, by the Company.

A reduction in the number of Participants does not result in a reduction or partial refund of the Tour Fee.

Failure of the group to appear for a scheduled tour without timely cancellation is considered a no-show and is nonrefundable.

4. Late Arrivals

The Booking Party is responsible for ensuring that Participants arrive at the designated meeting location by the starting time stated in the confirmation.

Because walking tours follow a scheduled route, the guide may be unable to delay the start of a tour or return to the meeting point for late-arriving Participants.

The late arrival or absence of one or more Participants resulting from transportation delays, difficulty locating the meeting point, or other circumstances outside our control does not ordinarily entitle the Booking Party to a full or partial refund of the Tour Fee.

Participants should allow sufficient time for public transportation, traffic, security restrictions, street closures, and other conditions common in New York City.

5. Weather

Walking tours take place outdoors and may operate in a variety of weather conditions.

Participants are responsible for checking the forecast and dressing appropriately for expected conditions, including rain, heat, cold, sun, or wind.

Weather that is inconvenient or uncomfortable does not necessarily require cancellation of a tour. However, because our tours involve extended periods of walking and standing outdoors, tours will normally be canceled or rescheduled when the forecast heat index is expected to reach or exceed 95°F (35°C), when the forecast wind chill is expected to reach or fall below 20°F (-7°C), or when sustained winds or wind gusts are expected to exceed 30 mph during the tour.

These thresholds are guidelines rather than absolute guarantees of cancellation. We may also consider precipitation, ice or snow, thunderstorms, air quality, official weather advisories or warnings, and actual or reasonably anticipated conditions along the tour route.

We reserve the right to delay, modify, reschedule, or cancel a tour whenever we determine that weather or related conditions make proceeding impractical or unsafe, even when the thresholds above have not been reached.

Weather-related decisions will be made as reasonably practicable based on the information available to us. When possible, we will notify the Booking Party promptly using the contact information provided with the reservation.

If we cancel a tour because of weather and cannot provide a suitable alternative, the Booking Party will receive a refund of the Tour Fee paid to us for the canceled tour.

6. Changes or Cancellations by Us

New York City is an active urban environment. Streets, sidewalks, historic sites, parks, buildings, and public spaces may become inaccessible with little or no notice.

We reserve the right to alter a route, sequence of stops, meeting location, tour duration, or other tour details when reasonably necessary because of circumstances such as construction, street or sidewalk closures, security restrictions, public events, demonstrations, government action, weather, emergencies, or conditions at individual sites.

Such reasonable itinerary changes do not constitute cancellation of the tour and do not entitle the Booking Party to a full or partial refund.

We may cancel a tour because of guide illness, emergency, unsafe conditions, or other circumstances that make it impractical to provide the tour. If we cancel and cannot provide an acceptable alternative date or time, the Booking Party will receive a refund of the Tour Fee paid to us for the canceled tour.

Except where otherwise required by law, our responsibility for a tour that we cancel is limited to the Tour Fee paid to us for that tour. We are not responsible for incidental expenses such as transportation, parking, accommodations, meals, or other travel costs incurred by the Booking Party or Participants.

7. Physical Nature of the Tour

Our tours are walking tours conducted primarily on public streets, sidewalks, parks, plazas, and other public areas in New York City.

Participants should expect sustained walking and standing. Conditions encountered may include curbs, steps, uneven pavement, cobblestones or other irregular surfaces, crowded sidewalks, street crossings, construction areas, changes in elevation, and exposure to traffic and weather.

Each Participant is responsible for determining whether the tour is appropriate for their own abilities and circumstances.

If a Participant has a mobility or accessibility concern that may affect participation, the Booking Party or Participant should contact us before booking or as early as possible before the tour. We will make reasonable efforts to provide useful information about the anticipated route and to accommodate reasonable requests when practicable.

We cannot guarantee that every public location, sidewalk, street, historic site, building, or third-party facility encountered along a route will be accessible.

The inability of an individual Participant to complete all or part of the tour does not ordinarily entitle the Booking Party to a full or partial refund of the Tour Fee.

8. Safety and Assumption of Ordinary Risks

Participation in a walking tour involves ordinary risks inherent in moving through a busy urban environment. These may include pedestrian and vehicle traffic, bicycles and other wheeled devices, street crossings, crowds, curbs, steps, uneven or slippery surfaces, construction, weather, and the actions of other members of the public.

Participants are expected to exercise reasonable care for their own safety, obey applicable pedestrian and traffic rules, and follow reasonable safety instructions given by the guide.

By participating, Participants acknowledge and voluntarily accept the ordinary and inherent risks associated with walking through public areas of New York City.

Nothing in these Terms is intended to waive or limit any right or liability that cannot lawfully be waived or limited under applicable law.

9. Age Requirement

Our tours are designed primarily for adults and emphasize in-depth historical interpretation and discussion while walking through Lower Manhattan.

The minimum age for participation is 16. We are unable to accommodate children under age 16 on our regularly scheduled tours.

The Booking Party is responsible for ensuring that all Participants meet this age requirement and for communicating the requirement to everyone included in the reservation. A Participant under age 18 must be accompanied by a responsible adult.

A Participant under age 16 will not be permitted to participate in the tour. If a group arrives with one or more Participants under age 16, the tour may proceed without those Participants, provided the remaining group is able and willing to proceed and any Participants under age 18 continue to have appropriate adult accompaniment.

If the presence of Participants under age 16 prevents the group from proceeding, or if the number or age composition of the group materially differs from the information provided when the reservation was made, we reserve the right to decline to conduct the tour. Such a circumstance will be treated as a failure by the Booking Party to satisfy the participation requirements of the reservation, rather than as a cancellation by the Company, and will not entitle the Booking Party to a full or partial refund of the Tour Fee.

If you have questions about the age requirement, please contact us before making a reservation.

10. Conduct

We want tours to be enjoyable, informative, and respectful experiences for everyone.

Participants must behave in a manner that does not endanger, threaten, harass, or substantially interfere with the guide, other Participants, members of the public, or the reasonable conduct of the tour. Participants must also comply with the photography and recording requirements in Section 14.

If a Participant's behavior is disruptive or inappropriate, or if a Participant violates the photography or recording requirements in Section 14, the guide will ordinarily give that Participant one warning and a reasonable opportunity to correct the behavior. If the behavior or violation continues after that warning, the guide may require the Participant to leave the tour.

No prior warning is required when, in the guide's reasonable judgment, a Participant's conduct presents an immediate safety concern, involves threatening or abusive behavior, constitutes a deliberate or serious violation of the photography or recording requirements, or is sufficiently serious that allowing the Participant to remain would materially compromise the safety or experience of the guide, other Participants, or members of the public.

Removal of one or more Participants under this section does not constitute cancellation of the tour and does not entitle the Booking Party to a full or partial refund of the Tour Fee.

11. Personal Property

Participants are responsible for their own belongings during the tour.

We are not responsible for personal property that is lost, stolen, misplaced, or left behind, except to the extent responsibility cannot legally be excluded.

Loss of or damage to a Participant's personal property does not constitute cancellation or interruption of the tour and does not entitle the Booking Party to a refund, except as otherwise required by law.

12. Third-Party Locations and Services

Tours may pass through or visit public spaces, privately operated attractions, historic sites, restaurants, shops, transportation facilities, or other locations that we do not own or control.

Operating hours, admission policies, accessibility, security requirements, and availability at such locations may change without notice.

Unless specifically stated as part of the tour, we do not guarantee admission to any particular building, attraction, or other third-party location.

The unavailability of a particular location does not by itself constitute cancellation of the tour when a reasonably modified tour can be provided.

13. Historical Content and Itineraries

Our tours are interpretive historical experiences. Routes, stops, subjects, stories, and historical material may vary depending upon the particular tour, guide, conditions encountered, Participant interests, new historical research, and the time available.

Photographs, descriptions, maps, routes, and lists of locations appearing on our website or promotional materials are illustrative and do not constitute a guarantee that every depicted or described location will be visited on every tour.

Reasonable variations in route, content, sequence, or duration do not constitute cancellation of the tour and do not entitle the Booking Party to a full or partial refund of the Tour Fee.

14. Photography and Recording

Participants are welcome to take still photographs for personal, noncommercial use during the tour, except where photography is prohibited or restricted at a particular location.

Audio recording and video recording of the tour, in whole or in part, are not permitted. This includes recording the guide's presentation using a mobile phone, camera, audio recorder, or other recording device.

Participants should respect the privacy of other Participants and members of the public when taking photographs.

Commercial or professional photography, organized photo shoots, livestreaming, broadcasting, or other reproduction of the tour requires our prior written permission.

Failure to comply with these photography and recording requirements may result in removal from the tour in accordance with Section 10. Removal of one or more Participants for such a violation does not constitute cancellation of the tour and does not entitle the Booking Party to a full or partial refund of the Tour Fee.

We will not use an identifiable Participant's image for our own advertising or promotional purposes merely because that person participated in a tour. Where we wish to take or use identifiable photographs or recordings of Participants for promotional purposes, appropriate permission will be requested.

15. Intellectual Property

Our original tour materials, written content, photographs, graphics, branding, and original presentation materials are protected by applicable intellectual-property laws.

Participation in a tour does not grant the Booking Party or Participants permission to reproduce, publish, sell, commercially exploit, or substantially record and redistribute our tour presentation or proprietary materials.

16. Privacy and Communications

Information supplied in connection with an inquiry or reservation may be used as reasonably necessary to respond to the inquiry, administer the reservation, process payment, communicate tour information, provide customer service, maintain business records, and comply with legal obligations.

The Booking Party is responsible for providing contact information through which important communications concerning the reservation can reasonably be received.

Transactional communications concerning a reservation are separate from optional promotional or marketing communications.

Additional information concerning the collection and use of personal information may be provided in our Privacy Policy.

17. Complaints and Problems

If a problem arises during a tour, the Booking Party or affected Participant should bring it to the guide's attention when reasonably possible so that we have an opportunity to address it.

18. Website Information

We make reasonable efforts to keep tour descriptions, schedules, prices, photographs, historical information, and other website material accurate and current.

Information may nevertheless be corrected or updated, and tour offerings may change. The terms and details contained in a confirmed reservation control over general promotional material where there is a conflict.

19. Governing Law

These Terms and Conditions and any dispute arising from a reservation or tour are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any provision of these Terms that is determined to be invalid or unenforceable shall be interpreted or limited to the extent necessary to make it enforceable where permitted by law, without affecting the remaining provisions.

20. Entire Agreement

These Terms and Conditions, together with the Booking Party's confirmation and any additional terms expressly incorporated into the reservation, constitute the agreement concerning the booked tour.

No modification to a confirmed reservation is effective unless confirmed in writing, including by electronic communication, by the Company.
